Short sales are by no means "short". A short sale by definition is when a homeowner/seller owes more on their house, to their lender, than the amount they can sell the house for. For example, if owe $400,000 on your mortgage to Bank of America but can only sell your house for $350,000 - you will need to do a short sale.

Short sales are very prevalent. The fact is a large number of homeowners, who are considered "solid" financially have been affected by the downturn in the economy. Some are facing job losses, divorce, medical bills, etc.

A short sale is a way for homeowners to escape a foreclosure, which destroys your credit. A foreclosure is a matter of public record and will stay on your credit report for 10 years. In addition, it affects your ability to purchase another home in the near future. Another trend, is that employers are increasingly screening job applicants for poor credit and a foreclosure on your credit report could signal a red flag, that stands in your way of getting a job.

Unfortunately, since your home is not worth what you owe the bank, you cannot refinance your mortgage. The appraisal process will reveal that your house is not worth your loan amount.

Selling your house via a short sale requires an agent, who understands the process. Your agent will be working with your bank on your behalf. Banks are very precise about required documentation and the way that it must be presented. Your realtor handling the short sale must be meticulous and committed. The wrong agent could mean your house being on the market for 6 - 9 months, with you ending up in foreclosure.

Please beware: NEVER EVER sign the deed to your house over to someone, who claims they can help you avoid foreclosure. The only way to avoid foreclosure is to sell the house or consult with an attorney about bankruptcy.

I've been asked this question several times.

Do you discount your real estate commission, when you sell a house? What if I don't have enough equity in my home to pay for your broker commission? What if I have to do a short sale and can't pay for your commission?

The short and simply answer to this is "yes". There are a number of cases, where clients simply can't afford to pay a full 3% commission to the listing agent. Some of these cases include situations where a homeowner has to sell a house under 3rd party approval - aka short sale. In this case, the homeowner usually doesn't pay the listing broker's commission. The homeowner's bank pays for the listing agent and buyer agent's commission.

In cases where a homeowner needs to sell due to divorce, financial hardship, sudden relocation or job loss, there may not be enough equity in the home for a full commission.

BEWARE. Real Estate agents who market themselves as "discounted" agents often do nothing other than putting your home into our MRIS system. A large number of these agents are part-time agents. They already have a steady source of income from their "real" jobs. Trying to sell your house is extra income - it doesn't make or break them.

As a full time agent, you HAVE to sell homes. Period. So, yes, I will work just as hard to sell your house, even with a 2.5% commission.

There is a lot to be said, when you enjoy what you do and find great friendships along the way. When things fall in place, your new friendship is worth a few bucks.

$8000 First-time home buyer tax credit extension and existing homeowner tax credit of $6500

The senate passed the bill that extends the first-time home buyer credit of $8000, yesterday.

Today, the house approved the measure, which extends the $8000 first-time home buyer credit until June 30, 2010. Home buyers must has a sales agreement by April 30, 2010 and close/go to settlement by June 30, 2010.

The measure which passed comes with an additional bonus. Existing homeowners who have lived in their homes for 5 years (consecutively) over the past 8 years can qualify for a $6500 credit.

Qualification income for first-time home buyer credit and existing homeowner credit.

$125,00 for single tax filers. $2250,00 for joint tax filer. This is an increase over the current $75,000/$125,000 limits.

Mayor Katz has been mayor of Gaithersburg since 1998 and won with approximately 60% of the votes. The mayor owns Wolfson's department store on East Diamond avenue. Should I Sell My house Without a Realtor? For Sale by Owner (FSBO) or Real Estate Agent - Maryland

This is the eternal question that has plagued every homeowner. The fact is whether most agents admit to it or not - before they became realtors they most likely considered selling their homes by themselves without an agent. I know I did.

Here is my honest answer.

1. Ask yourself this question.
Do you have an immediate need to sell your house due to a job relocation, divorce, school district, death in the family, etc or do you have an extended period of time to move (e.g. 6 months to 24 months)?

If you have an immediate need to move but would like to FSBO without a real estate agent, ensure that you have a strong understanding of the home selling process.

1. Educate yourself on Maryland and Montgomery county laws about selling your home. This includes disclosures that must be furnished to potential home buyers regarding property condition, lead, home inspection, etc.

2. Make sure that your contracts are written and executed legally.

3. Be patient. You will be fielding tens of calls from "lookie lus," interested in finding a bargain without any real interest. Most buyers who are seriously interested in purchasing a home will have an agent who researches and shows them homes, handles their contract, loan, inspection, appraisal and settlement details. People will break appointments after you have spent a great deal of time cleaning your house and rearranged your plans - it's part of the selling process.

4. DON'T use a discount brokerage. You know the ones that I'm talking about. They promise to list your house in MLS for $199 in hopes that they can trick you into the $3000 or $4000 package. The kicker is that you still do most of the work. Your mom was right,"there is no such thing as a free lunch". The internet is a great way to advertise. Take advantage of free websites such as craigslist.com to get the word out. Don't forget friends and family and lots of directional signs. Hold open houses.

5. Be prepared to negotiate your listing price for a number of reasons - investors, buyers who want a cash subsidy, special home buyer program purchasers, etc. Some buyers may also negotiate a reduction of the list price since you are not listed with an agent. Give some thought to how you want to negotiate. The NAR estimates that the average FSBO sold for 16% less than an agent assisted sale. Research the selling prices for homes similar to yours in your neighborhood.

6. Cooperate with buyer agents. Since serious buyers will have an agent, a good way to have as many serious buyers look at your house is to offer a buyer's agent commission. Beware that some agents see FSBO homes as double the work because they often have to represent their buyer and assist the seller to a certain degree in order to ensure that the process goes smoothly. Be nice to cooperating agents, who are agreeable enough to show your house to their serious buyers, because some agents are reluctant to do so at all.

7. Advertise as much as you can. Advertising can be expensive. A small ad in the Washington Post can run you hundreds of dollars. Make sure you draft an attractive ad that will draw as many "serious" buyers as possible. As I mentionned don't put yourself out there for the "lookies". Look at how realtors word their ads.

8. Declutter your house and improve curb appeal. Prospective buyers should feel "good," when they walk into your treasure. Have you ever visited the model house in a new subdivision (e.g. Pulte, NV Homes, Ryan Homes)? Try to evoke this feeling. You may have to hide your little knicks knacks, when you are show your home to buyers but it's worth it.

9. Selling your home is THE mission - don't forget that. If there is lackluster interest in your home or if you sense that you will not receive any offers soon, don't give up. Sit down with one or two realtors and interview them for the job. The NAR estimates that 80% of FBSO sales eventually sell through an agent.

Montgomery County First Time Home Buyers Qualifying for $8000 credit

If you are planning on purchasing a house between now and December 1, 2009 and you are a first time home buyer - you qualify for the $8000 first time home buyer credit.

First time home buyer is defined as someone who hasn't owned a house in the past 3 years. You must also live in your house for at least 3 year. If you fail to live in your house for at leaset 3 years - you will be required to repay back the $8000 credit amount.

Double tax filers should make less than $150,000 and single tax files must make less than $75,000.

If you have questions about whether you qualify or how much you are eligible to receive, your best bet is to confer with a seasoned tax professional - the only person that would be able to assess your situation.

I get this question often that I thought it would be a good time to address it. In most cases a home buyer - whether a first time home buyer or experienced buyer does not pay commission to a buyer's agent. The seller of the house offers a cooperating commission to the buyer's agent.

When most buyers hear this they are astonished and wonder why anyone would buy a house without an agent. The fact is that even the most savvy home hunters sometimes don't really understand this fact. I can also say that before I became a realtor - I really didn't understand this aspect of commissions and the worst part is that no realtor ever bothered to explain it me!

A buyer's agent submits your offer (Up to 60 pages on a standard contract) to the lender. NEVER submit an offer without understanding the disclosures and laws governing home sales in Montgomery county and Maryland. It's the law! Don't get yourself into trouble.

I get tons of questions from first time home buyers about FHA mortgage loan programs. Should they? Shouldn't they? The fact is FHA loans are excellent for first time home buyers. If you are working with a reputable lender, they will let you know what loan program fits you best.

FHA Loan in Summary: The FHA doesn't really lend you money. Instead they insure that loans so that lenders can give you a loan with favorable terms.

First Time Home Buyers - Montgomery County, PG County and Howard County

As of yesterday there were 300 mortgage loan programs available to first time home buyers in Maryland.

First Time Home Buyers, if you are purchasing a home within the next two months to four months rest assured there is a loan program for you. I know, I'm currently helping several first time home buyers who thought they couldn't afford a home.

There are excellent mortgage loan programs that assist first time home buyers with closing cost, downpayment, etc. There are also a number of programs that allow first time home buyers to purchase a home with little or no downpayment.

Programs include FHA loan, CDA, HOC, VA, etc. FHA loans now have a new higher limit and lower down payment requirements.

Contact me immediately to make arrangements to qualify you for the right loan. These loans are very stable most of which are provided through the state of Maryland, Montgomery County, etc.

The interest rates on these loans are simply unbeatable. Consider the interest rates on the Maryland Community Development Administration (CDA) mortgage loans.

Please keep in mind that only designated lenders are authorized to service these loans. Those who don't service them usually have no idea about these programs and will not mention them to you during the mortgage prequalification process.

Delia's Dozen to Bring My Sellers More Money

Cultivate Curb charisma. Some of the best buyers are the most impatient because they need to make a decision fast. If the view of your house from the street turns them off, they might not even stop. Shape up your front yard fast.

Take a critical look at your house’s front. If it’s weathered looking, if anything needs to be hauled to the dump – eliminate these problems. Don’t turn your buyers off outside before the inside can turn them on.

Never stay in your house with house hunters. Let the agent handle it, and remove yourself if you possibly can. Remember, the agent has worked for many hours with these potential buyers, knows what they’re looking for, and how to work with them. Let him or her do the job without interference.

Give your dogs and cats a vacation. They need it and so does your pocketbook. Having pets around (especially aggressive dogs) when you’re selling your home can be incredible expensive. Many people are acutely uncomfortable around some animals, and simply can’t think buy when their minds are on bye.

A few cans of paint and putty to brighten up your homes’ interior are the best investment you can make when you’re selling a house.

Drips do more than run up your water bill. They focus the attention of possible buyers on your house’s entire plumbing system, and cause them to worry. Fix these little problems before they cost you a sale.

Squeaking doors and creaking floors, torn or missing screens, cracked glass, and anything in need of repair dampens the house hunter’s enthusiasm. Many buyers believe there will always be ten problems they haven’t noticed for everyone one they see.

Hide (or neatly arrange) everything connected with work: lawnmowers, garden hoses, vacuum cleaners, and all the gear you used to fix up the house. Accent everything connected with play and relaxation: sound systems, skis, toys in the kids’ rooms.

De-clutter. Repack compactly, dispose of unneeded items, or rent storage space and move out as much material as you can. Your home’s storage space can’t look adequate to a buyer if you’ve got it jam-packed.

Turn up the shelter. If it’s hot, cool it; if it’s cold, light a crackling fire.

Harmonize the elements. Turn the music on softly and the TV off. Turn on all lights, day or night. Open the drapes in the daytime.

You can sell pride of ownership faster and for more money. It’s called cleanliness, and fresh cleanliness has more buyers than used dirt. Put sparkle in your bathrooms and kitchen, and you’ll take lots more silver out.

Interest Rates are edging up - should you worry?

30 year interest rates hit a 3 month high in the beginning of the month. No, the sky is not falling. It's always important to keep in mind what favorable interest rates we have been enjoying these last few years. A slight increase in interest rates, should not deter buyers from coming into the market. In local markets such as Gaithersburg, Olney, Montgomery Village, Rockville and Potomac - we are still seeing a lot of activing during Open houses and home buyer seminars.

There are still a number of excellent first time home buyer programs available to buyers that offer extra low rates and assistance with downpayment and closing costs.

Gaithersburg and the ICC - It's Coming!

Gaithersburg has never been hotter. With the ICC coming, sellers will be in a better position to market their properties. Gaithersburg is close enough to 270 and the coming ICC without being too close. Buyers like convenience but they don't want a highway cutting through their backyard.

If you live in Gaithersburg, Germantown and Montgomery Village areas - the ICC is a true gift. I would love to hear comments from homeowners in the area.

Selling Your Gaithersburg House This Spring?

Real estate is local. Don't believe the hype you see in the papers about the sky falling. There are still houses which appear on the market and are sold in 2 weeks. I had an open house today and met five serious buyers who were working with agents to purchase a home in the Gaithersburg/Olney areas in the next two months.

The buyers are coming! This means that homes are going to sell.

If you are thinking about selling your house, be sure to list within the next 2 to 4 weeks to take full advantage of the spring market. The key to selling fast is (1)Pricing well and (2)Ensuring that the house is in "move-in" condition. Buyers like a home that they can move into with little or no work.

Of the five buyers who stopped by my open house today, two of them indicated that they were interested in homes that were in move in condition. They elaborated further that, even if a foreclosure or short sale property was a bargain, they couldn't afford to fix it up. They didn't have the time or the cash on hand to replace a bathroom, kitchen, etc.

Sellers, your buyers should feel like they can unpack their furniture and start living in their dream home.

Sellers, get ready for a brisk spring market!
